General Terms and Conditions of Business

 

1 Scope of application

The following terms and conditions apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers.

Consumers are persons who purchase goods or services for purposes that are not related to their commercial or professional activity.

2 Contractual partner, conclusion of contract, correction options

The purchase contract is concluded with Kuhn Rikon AG.

By placing the products in the online shop, we make a binding offer to conclude a contract for these products. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the products contained in the shopping basket by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

3 Contract language, contract text storage

The language(s) available for the conclusion of the contract: German, English, French

We save the text of the contract and send you the order data and our GTC in text form. For security reasons, the contract text is no longer accessible via the Internet.

4 Subject matter of the contract

4.1 Product description

Reference is made to the validity of the respective product description as an integral part of the contract.

Without prejudice to your statutory warranty rights, we would like to draw your attention to the following special features. If you are unsure, please contact us:

Due to individual screen configurations (e.g. resolution and brightness), slight deviations between the displayed and actual product colours are possible.

In the case of wooden products, natural variations in the grain, structure and colour of the wood are possible.

5 Delivery conditions

5.1 Shipping costs

Standard shipping is free of shipping costs from an order value of CHF 80 incl. VAT.

5.2 Delivery options

We ship the products to the delivery address specified in the order process.

We only deliver by mail order. Unfortunately, it is not possible to collect the goods yourself.

We do not deliver to packing stations.

6 Payment

6.1 Prices

The prices stated at the time of ordering apply. These are total prices and include statutory VAT.

6.2 Due date and default of payment

The price is due upon conclusion of the contract, unless a later date is specified in the following terms of payment.

The following applies to consumers: In the event of late payment, we reserve the right to charge you a fee of CHF 1.50 per reminder for the second and each subsequent reminder. You reserve the right to prove that the damage incurred is lower. Further claims remain unaffected by this.

The following applies to entrepreneurs: In the event of late payment, we reserve the right to charge you interest on arrears at a rate of nine percentage points above the ECB base rate and a lump sum of CHF 40. Further claims remain unaffected by this.

6.3 Payment methods

The following payment methods are generally available in our shop.

Credit card
You enter your credit card details during the ordering process. Your card will be charged immediately after placing the order. We offer Visa, Mastercard and American Express.

PayPal
In order to be able to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (‘PayPal’), you must be registered with PayPal, legitimise yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further instructions during the order process.

PayPal can offer registered PayPal customers, selected according to its own criteria, further payment methods in the customer account. However, we have no influence on the offering of these modalities; other individually offered payment modalities affect your legal relationship with PayPal. Further information on this can be found in your PayPal account.

Invoice
The invoice amount is due 30 days after receipt of the invoice and the goods by bank transfer to the bank account specified on the invoice. We reserve the right to offer purchase on account only after a successful credit check.

PostFinance
Twint: The goods are paid for directly with the TWINT account via mobile app. Debit card: Postcard or Post e-Finance are available for debit card payments. Your debit card will be debited when the order is finalised. PostFinance, Mingerstrasse 20, 3030 Bern

Gift card
The card number can be entered in the ‘Gift card’ field when completing the order and used as a means of payment. This card runs via the provider Boncard.

7 Retention of title

The product remains our property until full payment has been received. We are authorised to make a corresponding entry in the retention of title register.

8. transport damage

If goods are delivered with obvious transport damage, please complain about such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the carrier or the transport insurance company.

9 Warranty and guarantees

9.1 Warranty for defects

Unless expressly agreed otherwise below, statutory warranty law shall apply.

Information on any applicable additional guarantees and their exact conditions can be found with the product and on special information pages in the online shop.

You should check the condition of the goods received as soon as it is feasible in the normal course of business and, if defects are found for which the seller is liable, notify the seller immediately. If you fail to do so, the purchased item shall be deemed to have been approved, unless the defects were not recognisable during the usual inspection. If such defects are discovered later, the notification must be made immediately after discovery, otherwise the item shall also be deemed to have been approved with regard to these defects.

You must return the defective product to us with a detailed description of the defect. You shall bear the transport costs incurred. We provide a warranty by rectifying defects. This is done at our discretion either by rectifying the defect (subsequent improvement) or by delivering a defect-free item (replacement delivery). If the subsequent fulfilment fails, you are entitled to withdraw from the contract. This does not apply in the case of insignificant defects. The right to a price reduction is excluded. This exclusion of liability also extends to all claims that compete with the warranty rights, be they based on contract (Art. 97 ff. CO), tort (Art. 41 ff. CO), avoidance of the contract due to error (Art. 23 ff. CO), etc.

The following restrictions and shortened time limits do not apply to claims based on damage caused by us, our legal representatives or vicarious agents

- in the event of injury to life, limb or health

- in the event of wilful or grossly negligent breach of duty and fraudulent intent

- in the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)

- within the scope of a guarantee promise, if agreed, or

- insofar as the scope of application of the Product Liability Act applies.

The following applies to the purchase of used goods by consumers: if the defect occurs after the expiry of one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.

1. Scope

The following T&Cs apply to all orders placed via our online shop. The offer is directed exclusively at consumers with habitual residence in Germany, Austria or Switzerland.
 

2. Contractual partner, formation of contract

The purchase contract is concluded with Kuhn Rikon AG.

The display of products within the online shop constitutes a binding offer on our part to enter into a contract vis-à-vis the items. You may place our products in your basket without obligation and amend your entries at any time prior to submitting a binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in your basket. Once you have sent your order you will immediately receive a confirmation via e-mail.
 

3. Contract language, saving of the contract text

The languages available for concluding the contract are German, French and English.

The text of the contract will not be saved by us.
 

4. Delivery conditions

Delivery costs are added to the product prices as displayed. Delivery charges are explained within individual product offers.

We only dispatch goods en route; pick up by the customer is not possible. 

We do not deliver to packing stations.
 

5. Payment

The following payment methods are basically available in our online shop:
 

Credit Card
With the submission of the order, you are sending us your credit card details at the same time.
After your identification as the legal cardholder, directly after the order, we will ask your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company and charged to your card.
 

PayPal
During the ordering process you will be forwarded to PayPal's online website. To pay the invoice amount via PayPal, you must be registered there or register first, identify yourself with your access data and confirm the payment instructions to us. After submitting your order in the shop we instruct PayPal to initiate the payment transaction.
Directly afterwards, the payment transaction is carried out automatically by PayPal. You will receive additional information during the ordering process.
 

Debit card:
Debit card payments may be made using Swiss PostCards or PostFinance. Your debit card will be debited once the order has been completed.
 

Invoice
(subject to positive credit screening): place an order and request an invoice, and pay after you have received the goods. If you order per invoice, the net balance will be due within 30 days from the date on the invoice. The invoice will be included with the delivery. Please transfer the balance to the account number stated in the accompanying pay-in slip. Please note that due to restrictions, this form of payment is not available to all our customers.
 

6. Retention of title 

The goods shall remain our property until full payment is made. We have the right to make an appropriate note in the register of title retainment.
 

7. Damage during delivery

If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.
 

8. Warranty and guarantees

Statutory warranty rights apply. Information on any additional guarantees and their precise conditions that may apply can be found next to the product and on specific information pages in the shop, if applicable. 

The consumer shall, as soon as it is possible in the normal course of business, check the condition of the goods received and, if defects arise for which the seller is liable, notify the seller immediately. If the consumer fails to do so, the purchased goods shall be deemed to have been approved, unless they are defects in a way that could not have been detected during the normal inspection. If such defects arise later, the notification must be made immediately after discovery, otherwise the item shall also be deemed approved with regard to these defects.

9. Liability

We shall in any case be liable without limitation for claims due to damages that have been caused by us, our legal representatives or legal agents

• for injury to life, limb or health

• for deliberate or grossly negligent breach of duty

• for guarantee commitments, where agreed

• insofar as the scope of application of the rules on product liability are open.

For breach of material contractual obligations, the fulfilment of which make the proper execution of the contract possible at all and which the contracting parties may generally rely on and trust in being complied with, due to slight negligence by us, our legal representatives or legal agents, the amount of liability is limited to the foreseeable damages at the time of contract conclusion, the occurrence of which must typically be anticipated.

Ceteris paribus, claims for compensation for damages are excluded.
